What we do
devShipsFast provides software development services. We work on a fixed-scope, fixed-price basis. After we both agree on the deliverables and timeline, we build, review, and ship the product you've scoped with us.
Proposals and agreements
Our process begins with a scope call. Within 48 hours, we provide a written proposal that spells out:
- Exact deliverables
- Timeline
- Price
- Any constraints or assumptions on your end
If you accept the proposal, we confirm in writing and begin work. No work starts until both parties have signed off on the scope and terms.
Changes to scope
If requirements change materially after work begins, we'll provide a written amendment outlining the change, the impact on timeline and cost, and a revised proposal. You approve or reject the change; we do not proceed without your written agreement.
Payment terms
For fixed-scope projects, we invoice 50% upon signing the proposal and 50% upon delivery (when code is deployed to production and ready for handover). For retainer engagements, invoicing is monthly in advance.
Payment is due within 30 days of invoice. Late payments may incur a fee of 1.5% per month on the outstanding balance.
We accept wire transfer, ACH, and credit card (with applicable processing fees passed to you).
Intellectual property
Upon full payment, all custom code, designs, and deliverables created for your project are fully owned by you. This includes the repository, any documentation, and the right to modify, sell, or distribute the software.
You own the code and infrastructure from day one. We do not retain any ownership, licensing rights, or backend access beyond the handover period.
Handover and support
We provide 30 days of post-launch support at no additional cost. This includes:
- Bug fixes
- Small feature adjustments
- Documentation review and updates
- Handover call and walkthrough of the codebase
After 30 days, ongoing changes are available via retainer or one-off project scopes.
Limitation of liability
Our total liability for any claim arising out of this agreement shall not exceed the total amount paid by you in the preceding 12 months. In no event shall either party be liable for indirect, incidental, consequential, or punitive damages, including lost revenue or data loss, even if advised of the possibility of such damages.
This limitation does not apply to liability for indemnification obligations or breaches of confidentiality.
Confidentiality
We keep your business information, source code, and project details confidential. We do not discuss specifics of your product or business with other clients. We may reference the fact that you are a client and share high-level outcomes (timelines, metrics) publicly unless you request otherwise in writing.
Cancellation and refunds
If work is cancelled before delivery, you remain responsible for payment for all work completed to that point plus any non-recoverable costs incurred (e.g., third-party services, infrastructure setup). Upon cancellation, we transfer all work-in-progress code and documentation to you.
Refunds for delays or dissatisfaction are not provided; instead, we will work with you to resolve issues or adjust scope.
Warranties and disclaimers
We warranty that we will perform services in a professional, workmanlike manner consistent with industry standards. However, we do not guarantee that the software will be error-free, fault-tolerant under all conditions, or suitable for every use case you may discover after launch.
The software is delivered "as-is" after handover, except for the 30-day post-launch support period.
Governing law
These terms are governed by the laws of the jurisdiction in which devShipsFast is based. Any disputes shall be resolved through negotiation, mediation, or arbitration as agreed upon by both parties.
